1. Nature of Agreement
This agreement (Agreement) is between you (Member) and the store at which you applied for membership in the
Home Team Retail Rewards Program (Program) (Store). The Store is a member of the Home Timber and Hardware
Group and participates in the Program administered by John Danks & Son Pty Ltd (ACN 004 037 049) (Danks).
Members of the Program can earn and redeem points and receive certain rewards, benefits, discounts or special
offers as offered by the Store from time to time.
2. Becoming a Member
An individual (not a trader or business) may become a member of the Program by completing and returning this
application form and being issued with a membership card (Card). In applying for and using the Card the Member
agrees to be bound by these terms and conditions, as varied from time to time, and any terms and conditions
issued by the Store (available on request). The Store may refuse to accept a person as a Member of the Program
at its discretion.
3. Earning and using points
Members can earn points by presenting the Card when purchasing items at the Store.
Points cannot be earned at any store other than the Store, being the store where the Member applied for
membership in the Program. Points cannot be earned when a gift card is purchased or used. The Store will
record the number of points earned by each Member and Members may check their points balance in the Store or
on Home Hardware´s website (www.homehardware.com.au) (Website). Any points issued as a result of fraud,
dishonesty or error, or that relate to a purchase by the Member that is subsequently cancelled or refunded,
will be cancelled by the Store. Points automatically expire 12 months after issue, or such other period as
the Store may determine.
The Member may redeem their points for a range of products at the Website by making a rewards request in the
Store (Rewards Request). The Store is responsible for reviewing and honoring Rewards Requests and may, in its
absolute discretion, refuse to authorize such Rewards Requests. Points are not redeemable for store credit or
cash. It is the Member´s responsibility to comply with any conditions imposed by the Store for the redemption
of Points. All products offered on the Website are subject to availability and subject to change from time to
time. Points and any benefit they confer are not property, do not have any cash or monetary value and cannot be
sold, transferred, assigned or otherwise dealt with other than in accordance with these terms and conditions.
From time to time, the Store may offer Members certain discounts or special offers as part of the Program.
Such discounts or special offers cannot be used in conjunction with any other discount or special offer.
4. Cards
The Card is not a credit card or charge card, is not transferable (except that the Member may permit their
immediate family to use the Card), and remains the property of the Store and Danks. Members must immediately
notify the Store if they change their address, if their Card is lost or stolen or if an unauthorized transaction
takes place in relation to the Card. To the extent permitted by law, the Store and Danks are not liable for any
delay in replacing a Card or for any unauthorised use of the Card. The Store or Danks may charge a fee of $2.50 for
the replacement of the Card.
5. Privacy
The Store collects Members´ personal information from the application form and stores this information in the
internal database (Database). The Database will also contain information concerning each Member´s points
balance, receipt of rewards and benefits and purchases made from the Store. Danks may use Members´ personal
information to manage and administer the Program, to carry out direct and other types of marketing, for planning
purposes, for product development, for research and for any other purpose relating to the Program. Danks may
disclose Members´ personal information to their subcontractors or affiliates or suppliers for these purposes. If
a Member would like to access their personal information or requires further information regarding Danks´
handling of Members´ personal information, please refer to Danks´ Privacy Statement [insert webpage for privacy
policy].
6. Changes, suspension or termination
Subject to applicable law, the Store may at any time, at their discretion and with or without prior notice to
Members, change these terms and conditions, suspend, amend or terminate the Program or cancel a Member´s
membership, even if this would have or may have the effect of reducing or eliminating the number of rewards
and benefits offered, or the period for receiving any offer. In particular, the Store may cancel a Member´s
membership if the Member, or someone using the Member´s Card: (a) fails to comply with these terms and
conditions; (b) abuses any privilege accorded to the Member as a member of the Program; or (c) supplies false
or misleading information or makes false or misleading misrepresentations to the Store or any other store
participating in the Program in connection with the Program.
The Member may cancel their membership at any time by notifying the Store either by contacting the Store directly
or via the Website. On receipt of such notice, the Store will terminate the Member´s membership and will note
on the Database that the Member´s membership is inactive.
The Store will attempt to notify Members of any significant changes to the Program by posting a notice on the Website, or by such other means as the Store may determine, but, to the extent permitted by law, is not obliged to do so.
7. General
To the maximum extent permitted by law, the Store: (a) expressly excludes any conditions or warranties
(whether express or implied and whether arising under statute or otherwise) as to the condition, quality or
fitness for any purpose of any goods or services supplied by the Store in connection with the Program;
and (b) expressly excludes any and all liability for any loss or damage (whether arising out of breach of these
terms and conditions, tort or statute) suffered or incurred by a Member as a result of any act or omission of
the Store (or its subcontractors or affiliates) in relation to the Program, including without limitation, any
change to, suspension, or termination of, the Program, the cancellation of any person´s membership in the
Program, or any errors or omissions in recording or issuing points.
8. Liability
To the extent permitted by law, Danks is not liable for any loss the Member may suffer, whether directly or
indirectly, under or in relation to this Agreement or the Program, including without limitation, any change
to, suspension, or termination, of the Program, or the Store ceasing to participate in the Program.
Treat this card like cash. Defaced, mutilated, lost or stolen cards will not be replaced, refunded or
redeemed. This card is redeemable for merchandise or services at participating Home Timber and Hardware
stores, Thrifty-Link Hardware stores and Plants Plus Garden Centres; Not redeemable for cash and cannot
be used for payment of credit or retailer accounts; Must be redeemed before the expiry date shown on the
card; Will be void and may not be redeemable after the expiry date; Cannot be reloaded; is partially
redeemable; Cannot be used on a sale under $10. Cash will not be given for any unused balance. Unused
balance on expiry of this card will not be refunded or credited. Purchases exceeding available balance
require difference paid by other method. For full terms and conditions please refer to the customer
service desk at the participating store. You are liable for all transactions on your card except to the
extent to which there has been fraud or negligence by us or any of our employees. Check available card
balance by calling 1300 55 33 80. In some cases fees may apply for the use of these cards, for details
call 1300 55 33 80. We reserve the right to change any terms contained in these Terms of Use at any time.
Changes to Terms of Use will be available at the participating store. Visit the customer service desk if
you have any reason to believe an error has occurred in relation to this card.
HOME TIMBER AND HARDWARE – THE PROPER TRAINING SESSION (“Promotion”) JOHN DANKS AND SON PROPRIETARY LIMITED TRADING AS HOME TIMBER AND HARDWARE (“Promoter”) COMMENCES: 00:01 AEST 01/05/09 CONCLUDES 23:59 AEST 31/05/10 (“Promotion Period”)
CONDITIONS OF ENTRY
The Promotion is conducted by the Promoter, which is John Danks and Son Proprietary Limited (ABN 64 004 037 049) trading as Home Timber and Hardware of 414 Lower Dandenong Road, Braeside Victoria 3195.
Information on How to Enter and prizes form part of these Conditions of Entry.
The Promotion is only open to individuals who:
I. are residents of Australia; and
II. are aged 18 years or older or are under 18 years of age, who have obtained their parent or guardian’s consent to enter the Promotion on these Conditions of Entry and whose parent or guardian have agreed to these Conditions of Entry; and;
III. are not employees of the Promoter, or any of its related corporations or any of their agencies associated with the Promotion; and
IV. are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee; and
V. have not been discovered to have breached conditions of entry of previous contests run by the Promoter.
The Promotion is not being offered or made available in the Australian Capital Territory.
All entrants are responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. Entry into this Promotion is deemed to be acceptance of these Conditions of Entry. The Promoters’ decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Conditions of Entry generally.
All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility to enter after the Promoter has awarded a prize to the ineligible person. Return of a prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
All prices stated are in Australian dollars, represent the recommended retail price and include GST. All references to times and dates are to times and dates in Melbourne, which may be Australian Eastern Standard Time (AEST) or Australian Eastern Daylight Time (AEDT) depending on the date. All times are stated using the 24 hour clock.
KEY DATES
The Promotion commences 01 May 2009 at 00:01 and closes 31 May 2010 at 23:59. There are 12 rounds for this competition as outlined below. The club that has accumulated the most points at the end of each round will be awarded the training session. The rounds are:

Round 2: Commences Wednesday 1st July 2009 00:01am (AEST) and closes Friday 31st July 23:59pm (AEST).

Round 4: Commences Tuesday 1st September 2009 00:01am (AEST) and closes Wednesday 30th September 2009 23:59pm (AEST).
Round 5: Commences Thursday 1st October 2009 00:01am (AEST) and closes Saturday 31st October 2009 23:59pm (AEDT).
Round 6: Commences Sunday 1st November 2009 00:01am (AEDT) and closes Monday 30th November 2009 23:59pm (AEDT).
Round 7: Commences Tuesday 1st December 2009 00:01am (AEDT) and closes Thursday 31st December 2009 23:59pm (AEDT).

DETAILED DESCRIPTION OF THE PRIZE
The prize awarded to the qualifying sporting club will be a 1 hour training session for a maximum of 25 participants worth $5000 (inclusive of GST) each (Prize). One Prize will be awarded at the end of each round. The total number of Prizes awarded for this Promotion will be 12. The Promoter will provide the sportsperson allocated to that sport along with two facilitators to assist in the running of the training session. The venue and all equipment will be supplied by the winning club at their expense. The Prize will also include the sportsperson running the training session staying at the club for one hour after the session to be available to sign autographs and have photos taken with club members.
The training session will be held within a 12 week period of the club qualifying for each round.
The winning club and its participants will only be entitled to participate in the training session once the winning club and each participant has signed a deed of waiver and release prepared by the Promoter. If the winning club does not sign the waiver and release, it will not be entitled to participate in the training session. Similarly, any participants who do not sign the waiver and release will not be entitled to participate in the training session.
A sporting club will not be entitled to win more than one Prize. Therefore, once a sporting club has won a Prize, that sporting club will be removed from the Promotion and will no longer be entitled or eligible to participate in the Promotion.
HOW TO ENTER
Anyone shopping at a Home Timber and Hardware store within each round will earn points for every dollar that they spend during the nominated round; 5 points for every $1 spent will be allocated to the individual’s nominated sporting club.
Home Timber and Hardware Loyalty Club Members (HOME TEAM Members) will receive 10 points for every $1 that they spend during the nominated round at their participating store (HOME TEAM Stores).
Individuals can go to www.homehardware.com.au/Home-Team for details on how to become a HOME TEAM Member (available in participating stores only). Check with your local store for participation details
Each time a purchase has been made, customers need to log onto www.homehardware.com.au (Promotion Website) and follow the prompts to enter their purchase details and allocate their points to their nominated club.
Entrants must retain a copy of their proof of purchase(s) and the Promoter may request such proof of purchase(s) for verification purposes.
Limit of one entry per receipt/transaction.
Any costs associated with accessing the Promotion Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
For a sporting club to be eligible for nomination:
(a) the club must be an Aussie Rules, Rugby League, Soccer, Basketball, Netball or Cricket Club that is lawfully recognised; and
(b) all of the required information about the club on the nomination form found on the Promotion Website must be supplied and completed by the customer nominating that club.
The club that has accumulated the most points at the end of each round will be awarded the training session. In the event that there is a draw in a round between two or more clubs (that is, more than one club accumulates the same number of points which is the highest number for that round), then the Promoter will consider the points achieved by the clubs in question in all previous rounds, and the club with the most overall points (up to the round in question) will be the winner for that round. In the event that:
(a) neither of these clubs have been nominated in previous rounds; or
(b) these clubs were awarded the same number of points (in total) from all previous rounds; or
(c) the draw occurs in the first round;
then the Promoter will consider the reason given on the nomination form for the clubs in question.
A sporting club will not be entitled to win more than one Prize. Therefore, once a sporting club has won a Prize, that sporting club will be removed from the Promotion and will no longer be entitled or eligible to participate in the Promotion.
HOW WILL THE RESULTS OF THE PROMOTION BE NOTIFIED AND WHEN
The qualifying clubs for each round will be contacted via telephone and published in The Australian.
Round 1: Winning club will be notified via telephone in the week commencing Monday 6th July 2009 and published in The Australian Thursday 16th July 2009.
Round 2: Winning club will be notified via telephone in the week commencing Monday 3rd August 2009 and published in The Australian Thursday 13th August 2009.
Round 3: Winning club will be notified via telephone in the week commencing Monday 7th September 2009 and published in The Australian Thursday 17th September 2009.
Round 4: Winning club will be notified via telephone in the week commencing Monday 5th October 2009 and published in The Australian Thursday 15th October 2009.
Round 5: Winning club will be notified via telephone in the week commencing Monday 9th November 2009 and published in The Australian Thursday 19th November 2009.
Round 6: Winning club will be notified via telephone in the week commencing Monday 7th December 2009 and published in The Australian Thursday 17th December 2009.
Round 7: Winning club will be notified via telephone in the week commencing Monday 11th January 2010 and published in The Australian Thursday 21st January 2010.

PERSONAL INFORMATION
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, Prize suppliers and as required, to Australian regulatory authorities.
Unless otherwise advised, entrants consent to the storage of their personal information on the Promoter´s database and the Promoter may use this information for future Promotion, marketing and publicity purposes regarding its products, including contacting the entrant via electronic messaging.
By entering their purchase details and allocating their points to their nominated club, entrants authorise the Promoter to use their name and/or likeness in connection with the Promotion for marketing and publicity purposes (including on the Promotion Website) without any further reference, payment or other compensation.
Entrants can request to access, update or correct their personal information which the Promoter holds about them or may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address below. Should a participant´s contact details change during the Promotion Period, it is the participant´s responsibility to notify the Promoter and the Promoter will not be responsible for a misdirected Prize claim.
The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
GENERAL
The Promoter accepts no responsibility for late, lost or misdirected entries or Prize claims.
The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who participates. No correspondence will be entered into.
If for any reason the conduct or operation of this Promotion is interfered with or disrupted in any way (including but not limited to, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, fraud, tampering, technical failures or any other causes beyond the control of the Promoter), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for any incorrect or incomplete information which may be communicated in the course of administering this Promotion.
To the extent permitted by law, the Promoter (including its officers, employees, contractors, agents and representatives) are not liable for any loss (including loss of opportunity) or damage (including but not limited to direct, indirect or consequential loss or damage), costs, expenses, claims, actions, liability or personal injury arising in any way from or in relation to:
(a) the Promotion;
(b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(c) any theft, unauthorised access or third party interference;
(d) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); and/or
(e) the Prize.
