1. Information on how to enter and the prize(s) form part of these Terms and Conditions. By entering the “Win 500,000 DIY Rewards Points” promotion (“Promotion”) you accept the Promoter’s Privacy Policy and these Terms and Conditions.

Entry is only open to Australian residents over the age of 18 years at the time of entry who are current DIY Rewards members as at the date of entry into the Promotion (each an “Eligible Entrant”). For clarity, individuals who are not current DIY Rewards members can sign up to be a DIY Rewards member during the Promotional Period, however individuals must be registered DIY Rewards members prior to making any transaction in order for the automatic entry to be applied.

4. Employees of the Promoter, participating Home Hardware retailers, and agencies and/or companies associated with the conduct of this competition (and their Immediate Family Members), are ineligible to enter. “Immediate Family Members” means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

5. Entries into the Promotion open at 6.00AM AEST on Wednesday 27 September 2023 and close at 11.00PM AEDT on Thursday 30 November 2023 (“Promotional Period”).

How to Enter:

6. To receive an automatic entry into the Promotion an Eligible Entrant must complete one (1) of the following steps during the Promotional Period:

1. In store:

• Spend $50 or more in a single transaction at a Participating Store and scan their DIY Rewards Card upon payment (“Qualifying In-Store Transaction”). Eligible Entrants will receive one (1) automatic entry for every $50 spent in a Qualifying In-Store Transaction during the Promotional Period. A participating store is any Home Hardware store in Australia that displays advertising material for this Promotion (“Participating Store”). For the removal of doubt, Qualifying In-Store Transactions paid for with redemption of DIY Rewards Points will still be valid for entry into the Promotion.

1. Online at homehardware.com.au:

• Spend $50 or more in a single transaction online at Homehardware.com.au and enter their DIY Rewards Card number at cart checkout in the DIY Rewards Card number field (“Qualifying Online Transaction”). Eligible Entrants will receive one (1) entry for every $50 spent in a Qualifying Online Transaction. For the removal of doubt, Qualifying Online Transactions paid for with redemption of DIY Rewards Points will be valid for entry into the Promotion.

7. Eligible Entrants must have a valid, contactable email address stored against their DIY Rewards account when the Qualifying In-Store Transaction or Qualifying Online Transaction takes place otherwise the entry may be deemed invalid by the Promoter.

8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per $50 spent in a Qualifying In-Store Transaction or Qualifying Online Transaction ; and (b) each entry must be submitted separately and in accordance with entry requirements, For the avoidance of doubt, if an Eligible Entrant spends, for example, $120 in a single Qualifying In-Store Transaction or Qualifying Online Transaction, the Eligible Entrant is entitled to two (2) entries for that Qualifying In-Store Transaction or Qualifying Online Transaction.

9. Cancelled or incomplete transactions will be deemed invalid. If an Eligible Entrant fails to scan their DIY Rewards Card or fails to enter their DIY Rewards Card number the transaction will be deemed invalid.

10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Prizes & Prize Draw:

11. All draws will take place at Database Consultants Australia, Level 6, 30 Convention Centre Place, South Wharf, Melbourne VIC 3006 at 2:00pm AEDT on Friday 15 December 2023. The Draw will be conducted in the presence of an independent scrutineer. The Winner will be notified in writing to the email address registered on the DIY Rewards Members account within two (2) business days of the relevant draw and published at https://www.homehardware.com.au/DIYrewards on Monday 18 December 2023.

12. There will be one (1) major prize draw (“Major Draw”) for this Promotion.

13. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

14. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. The Prizes must be taken as offered and cannot be varied.

15. The “Prize” in the Major Draw will be awarded as follows:

• The first valid entry drawn will win 500,000 DIY Rewards Points, applied to the DIY Rewards member account used on entry and valued at AU$5,0000.00 worth of products redeemable at participating Home Hardware stores or online at com.au.

16. The Major Prize must be redeemed within twelve (12) months from the date of issue and will automatically expire at this time on the DIY Rewards member account. It is the responsibility of the prize winner to ensure the Prize is redeemed in full. Any ancillary costs associated with redeeming any DIY Rewards Points are not included. Any unused balance of the DIY Rewards Points won will not be awarded as cash. If any part of the prize or the DIY Rewards points are redeemed in a transaction which is subsequently refunded, the prize winner will forfeit any DIY Rewards points used within this transaction. The DIY Rewards Points credited to the winning entrant’s account are subject to the prevailing terms of the DIY Rewards program from time to time.

17. The Major Prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash, unless otherwise specified. The Promoter reserves the right to substitute the Major Prize (or part of the Major Prize) with a prize (or prize component) of equal or greater value and/or specification (including where the Major Prize is unavailable), subject to any written directions from the regulatory authorities in each State and Territory where relevant.

18. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the Major Prize (or an element of the Major Prize) by the time stipulated by the Promoter, then the Major Prize (or that element of the Major Prize) will be forfeited.

19. Total prize pool value is $5,000.00 worth of products redeemable at participating Home Hardware stores or online at com.au.

20. A draw for any unclaimed prizes may take place on 18 January 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing to the email address registered on the DIY Rewards Members account within two (2) business days of the draw and published at https://www.homehardware.com.au/DIY-Rewards from 20 January 2024.

Validation:

21. Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome) and promoting any products and services or future promotions of the Promoter.

22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

23. In the event of war, terrorism, state of emergency, pandemic, government lockdown or any other kind of event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend, substitute or modify the Major Prize, subject to any written directions from a relevant regulatory authority Any changes to the Promotion will be notified to the Eligible Entrants in writing to the email address registered on the DIY Rewards Members account as soon as possible by the Promoter.

24. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, proof of purchase, age and place of residence), and reserves the right, in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

25. Any cost associated with accessing any website to participate in the Promotion is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.

26. It is a condition of accepting the Major Prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.

27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act 2001 or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

29. Except for any liability that cannot be excluded by law, the Promoter and their agent DCA Pty Ltd (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, fraud, unauthorised access or third party interference; (c) any entry or Major Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Major Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use or redemption of the Major Prize.

30. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.homehardware.com.au/legal/privacy-policy/ .In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how the Eligible Entrant may opt out, access, update or correct their PI, how the Eligible Entrant may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose the Eligible Entrant PI to any entity outside of Australia.
