'WIN YOUR SHOP BACK’ PROMOTION - For the full list of winners:

1. Information on how to enter and the prize(s) form part of these Terms and Conditions. By entering the “WIN THE VALUE OF YOUR SHOP BACK” promotion (“Promotion”) these following Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions will prevail.

Who can enter:

Entry is only open to Australian residents who at the time of entry who are current Mitre 10 ‘Mighty Rewards’ or Home Hardware ‘DIY Rewards’ members (together “Rewards Members”) (“Eligible Entrant”). For clarity, individuals who are not a current Mitre 10 Mighty Rewards or Home Hardware DIY Rewards member can sign up to be a rewards Member in store or online during the Promotional Period. However, individuals must be a registered Rewards Member prior to this.

4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion.

5. Eligible Entrants must have a valid, contactable email address stored against their Rewards Member account when making a Qualifying Transaction (defined below) otherwise the entry may be deemed invalid by the Promoter in its sole discretion.

6. Employees of the Promoter, participating Mitre 10 or Home Hardware retailers, and agencies and/or companies associated with the conduct of this competition, are ineligible to enter.

Promotion Dates:

7. Entries into the Promotion open at 12:01 AM AEST on Monday 7 April 2025 and close at 11:00 PM AEDT on Thursday 17 April 2025 (“Promotional Period”).

How to Enter:

8. To receive an automatic entry into the Promotion an Eligible Entrant must during the Promotional Period, make any purchase at a Participating Store (defined below) and scan their Mighty Rewards or DIY Rewards card upon payment (“Qualifying Transaction”). For clarity, online purchases made at Mitre10.com.au or homehardware.com.au where ‘in-store click and collect’ is set as the delivery option will also be included as a Qualifying Transaction.

9. Eligible Entrants will receive one (1) automatic entry for every Qualifying Transaction during the Promotional Period. For the removal of doubt, Qualifying Transactions paid for with redemption of Mighty Rewards or DIY Rewards Points will still be valid for entry into the Promotion, however only the portion of the Qualifying Transaction that is paid for in cash will be considered as the eligible amount when calculating the number of points awarded as a prize.

10. Bonus Entry: Entrants will receive one (1) bonus entry for every product from a participating “bonus” brand purchased in a Qualifying Transaction. The qualifying Bonus Brands are: Accent Paint / Dulux Paint / Cabots / Selleys / Yates / Neta / Stanley Fatmax V20 and Ox Tools. For clarity, this means if the Qualifying Transaction includes two (2) products across any of the bonus brands, the entrant will receive two (2) bonus entries.

11. Purchases of Mitre 10 or Home Hardware Gift Cards in-store or online are excluded from this promotion and will not form a Qualifying Transaction.

12. A participating store is any Mitre 10 or Home Hardware store in Australia that participates in the loyalty program and accepts Rewards Members cards (each a “Participating Store”). Participating Stores for this Promotion are available to view at mitre10.com.au/mighty rewards or homehardware.com.au/diyrewards.

13. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction; and (b) only one (1) entry permitted per bonus product purchased in a Qualifying Transaction.

14. Cancelled or incomplete transactions will be deemed invalid. If an Eligible Entrant fails to provide their Mighty Rewards or DIY Rewards Card number, the transaction will be deemed invalid.

Prize Draws:

15. Entries will be divided into three hundred and eighty seven (387) store groups (each a “Store Group”) depending on the Participating Store at which the entrant made a Qualifying Transaction, being either one of two hundred and ninety six (296) Mitre 10 stores or one of ninety one (91) Home Hardware stores. Participating Stores in each State/Territory is as follows:

  • ACT & NT: two (2) Participating Stores each;
  • TAS: twenty-three (23) Participating Stores;
  • WA: forty-two (42) Participating Stores;
  • SA: fifty (50) Participating Stores;
  • QLD: seventy-two (72) Participating Stores;
  • VIC: ninety-six (96) Participating Stores; and
  • NSW: one hundred (100) Participating Stores.

16. There will be one (1) draw conducted per Store Group for the entries received each day of the Promotional Period, for a total of eleven (11) draws per Store Group (“Daily Draws”). Subject to the starting time and closing time of the Promotional Period, entries into each Daily Draw will open at 12am and close at 11:59pm each day based on Victoria local time. Entries are valid only for Daily Draw for the relevant purchase date, and entries in each Daily Draw will NOT be entered into subsequent Daily Draw(s).

17. Daily Draws will take place at Database Consultants Australia, Level 6, 30 Convention Centre Place, South Wharf, Melbourne VIC 3006 at 2:00pm AEDT on the first business day after entries close for that Daily Draw, with the first Daily Draw taking place on 8 April 2025 and the last Daily Draw taking place on 18 April 2025. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in Victoria. Winners will be notified in writing to the email address registered on the Rewards Member account within two (2) business days of each Daily Draw and published (first initial, surname and postcode) at www.mitre10.com.au/mighty-rewards and www.homehardware.com.au/diy-rewards by Tuesday 6 May 2025 . The Winners must acknowledge acceptance of the Prize (defined below) via reply email to claim their Prize.

18. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

19. A re-draw for any unclaimed prizes with take place on 19 May 2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be contacted via email and their details (first initial, surname and postcode) will be published at www.mitre10.com.au/mighty-rewards and www.homehardware.com.au/diy-rewards on Friday 6 May 2025.

20. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. Prizes must be taken as offered and cannot be varied.

21. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the Prize by the time stipulated by the Promoter, then the Prize will be forfeited.

Prizes:

22. Mitre 10 in-store purchases: there will be one (1) prize available in each participating Mitre 10 store, for a total of two hundred and ninety-six (296) stores, each day of the Promotional Period. The first valid entry drawn in each Daily Draw for each Mitre 10 Store Group will win the Prize (defined below).

23. Home Hardware in-store purchases: there will be one (1) prize available in each participating Home Hardware store, for a total of ninety-one (91) stores, each day of the Promotional Period. The first valid entry drawn in each Daily Draw for each Home Hardware Store Group will win the Prize.

24. Each prize consists of Rewards Member loyalty points based on the value of the winning Qualifying Transaction, up to a maximum of 10,000 loyalty points, which may be redeemed for purchases with an approximate value of $100 (“Prize”). For example, if a winning transaction was $50, that winner will receive 5,000 loyalty points, which may be redeemed for purchases with an approximate value of $50.

25. Rewards Member loyalty points will be allocated to the winner’s membership account only and must be used within thirty (30) days from the date of allocation. Loyalty points do not have a cash value and cannot be converted to cash. The value is based on a sample of the Rewards Member loyalty points through the Rewards Member programs at the time of this Promotion. The estimate of value is provided for the purposes of licensing this Promotion and will vary depending on how and when they are redeemed by a winner through the Rewards Member program. Loyalty points are not exchangeable, transferrable and cannot be taken as cash.

26. There is a total of up to 4,257 Prizes available to be won during this Promotion. The total prize pool in each State/Territory is as follows:

  1. ACT: up to $2,200
  2. NT: up to $2,200
  3. TAS: up to $25,300
  4. WA: up to $46,200
  5. SA: up to $55,000
  6. QLD: up to $79,200
  7. VIC: up to $105,600
  8. NSW: up to $110,000

27. For clarity, a winner’s membership loyalty tier status (being either Gold, Silver or Bronze memberships) and any associated bonus loyalty points accrual (for example, double points accrual for gold memberships) is not relevant for the purposes of this Promotion. Any membership loyalty tier status does not entitle any winner to receive any other prize or points value other than as set out in these T&Cs.

28. If a winner redeems any part of a Prize in a transaction that is subsequently cancelled, returned or refunded, the prize winner will forfeit any loyalty points awarded as a Prize that are used within this transaction. Prizes credited to the winning entrant’s account are always subject to the prevailing terms of the Mighty Rewards or DIY Rewards program.

29. The Prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash, unless otherwise specified. The Promoter reserves the right to substitute the Prize with a prize (or prize component) of equal or greater value and/or specification (including where the Prize is unavailable), subject to any written directions from any regulatory authorities].

General Terms:

30. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

31. Eligible Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

32. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

33. In the event of war, terrorism, state of emergency, pandemic, government lockdown or any other kind of event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a Prize, subject to any written directions from a relevant regulatory authority.

34. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, proof of purchase, age and place of residence), and reserves the right, in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

35. Any cost associated with accessing any website to participate in the Promotion is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.

36. It is a condition of accepting the Prize that the winners may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.

37. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act 2001 or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

39. Except for any liability that cannot be excluded by law, the Promoter and their agent Pinpoint Pty Ltd (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, fraud, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use or redemption of a Prize.

40. The Promoter collects personal information ("PI") to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.metcash.com/legal/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how the Eligible Entrant may opt out, access, update or correct their PI, how the Eligible Entrant may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose the Eligible Entrant PI to any entity outside of Australia.

41. The Promoter may also disclose PI to our Promotional Partners, if an Eligible Entrant consents to such disclosure during the Promotion, who may use the information for their own marketing purposes. For details on how PI will be handled by our Promotional Partners, an Eligible Entrant should view their privacy policy.
