Terms and Conditions
- Information on how to enter and the prize(s) form part of these Terms and Conditions. By entering the “Get in, Get out, Drive it away - Mitre 10 and Home Hardware Trade” promotion (“Promotion”) you accept the Promoter’s Privacy Policy and the following terms and conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions will prevail.
- The Promoter is Mitre 10 Australia Pty Ltd (ABN 98 009 713 704) of 19 Corporate Drive, Heatherton VIC 3202, Phone 1300 880 440.
Who can enter:
- Entry is only open to Australian residents aged 18 years or over who have held a Mitre 10 or Home Hardware commercial or cash trade account since at least 01/04/24 (“Eligible Individuals”).
- Employees (and their immediate families) of the Promoter, Participating Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- A “Participating Store” is any Mitre 10 or Home Hardware store located in Australia that displays material relating to the promotion during the Purchase Period. There will be a total of five hundred and thirty-six (536) Participating Stores for the promotion. For a full list of Participating Stores please visit:

Promotion Dates:
- Entries into the promotion open and close on the below dates:
- Opens 01/04/25 and close at 11:59pm AEST on 31/05/25 (“Purchase Period”); and
- Opens 01/04/25 and closes at 11:59pm AEST on 21/06/25 (“Registration Period”).
- To be eligible to enter, Eligible Individuals must complete the following steps during the Purchase Period:
- Purchase any product at their local Participating Store using their Local Trade Commercial account for that Participating Store;
- Participating Stores will then provide the Independent Hardware Group (“IHG”) the data of all Eligible Individuals that have increased their spend year over year by 10% for the months of April and May – i.e. by comparing the Eligible Individual’s expenditure figures for April and May 2025 to April and May 2024 (“Spending Target”). Participating Stores must provide the sales data for April to IHG by 14/05/25 and the sales data for May to IHG by 14/06/25. Eligible Individuals then have until 21/06/2025 to submit their entry forms as per clause 8 below.
How to Enter:
- To enter, Eligible Individuals must then complete the following steps during the Registration Period:
- Using the data received from Participating Stores, IHG will then send out email invitations to Eligible Individuals that have met the Spending Target to register into the promotion. IHG will send invitations to Eligible Individuals once the Participating Stores have provided the data.
- Eligible Individuals must click through the invitation, locate the entry form, insert the requested information and submit the fully completed form online.
- Only one (1) entry permitted per month that satisfies the Spending Target, for a total maximum of two (2) entries during the promotion period; and each entry must be submitted in accordance with entry requirements.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- Incomplete or indecipherable entries will be deemed invalid.
- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Prizes & Prize Draw:
- Each Eligible Individual will be inserted into three (3) draws:
- National Draw: Consists of all Eligible Individuals for the promotion. There is one (1) National Draw for the promotion;
- State Draw: Depending on the state selected in an Eligible Individual’s entry form, entries will be divided into the below groups for a total of six (6) State Draws:
- NSW and ACT
- SA and NT
- VIC
- WA
- QLD
- TAS
- Store Draw: Depending on the Participating Store selected in an Eligible Individual’s entry form, entries will be placed into one (1) Store Draw. There will be a total of five hundred and thirty-six (536) Store Draws (one (1) for each Participating Store).
- All draws will take place at Handling Matters, Unit 40, 1-5 Thew Parade, CROMER NSW 2099 on 30/06/25 at 1:00pm AEST and in the presence of a scrutineer where the prize pool of a draw exceeds $10,000. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The Winners will be notified by email and telephone within two (2) business days of the relevant draw. The Winners will be published (first initial, surname and postcode) online at https://www.mitre10.com.au/trade/trade-promotion or https://www.homehardware.com.au/trade-centre/trade-promotion from 02/07/25.
- The Promoter’s decision is final and no correspondence will be entered into.
NATIONAL DRAW:
- The first valid entry drawn from the National Draw will win a Toyota Hilux GR-S with automatic transmission or $50,000 in the form of an electronic funds transfer into the winner’s nominated Australian bank account in the winner’s name, depending on the winner’s preference (“National Prize”).
- The total prize value of the Vehicle is up to $87,692.06 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner’s colour preference (excluding metallic options), subject to availability. The winner must collect the prize from their nearest authorised Toyota dealership.
- If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
STATE DRAW:
- The first valid entry drawn from each State Draw will each win a $10,000 credit to the winner’s Mitre 10 or Home Hardware Trade store trade account, as applicable (“State Prize”).
STORE DRAW:
- The first five (5) valid entries drawn from each Store Draw will each win a $50 Mitre 10 or Home Hardware gift card, depending on the Participating Store in the Eligible Individual’s entry (“Store Prize”).
- Any ancillary costs associated with receiving the National, State or Store Prizes are not included. Any unused balance of the State or Store prizes will not be awarded as cash. Redemption of the State and Store prizes is subject to any terms and conditions of the issuer, including those specified on the gift card.
- Subject to the unclaimed prize draw clause, if for any reason a winner does not take their prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is $281,692.06.
- Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any unclaimed prizes may take place on 30/07/25 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and telephone within two (2) business days of the draw and their names (first initial, surname and postcode) will be published online at https://www.mitre10.com.au/trade/trade-promotionor https://www.homehardware.com.au/trade-centre/trade-promotion from 01/08/25.
Validation:
- Eligible entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- If the Promoter does not receive any data for qualifying entries from a Participating Store or from Participating Stores in a single State, the prizes for that Participating Store draw or State draw will be deemed unwon and will not be awarded.
- If an Eligible Individual enters using a Mitre 10 or Home Hardware Trade account associated with a business, the prize will be awarded to the owner of that business who may, in their absolute discretion, allocate the prize to any employee of that business. The owner must notify the Promoter of that transfer (in writing) by 31/08/2025 and must not issue the prize without the Promoter’s approval. Approval of the transfer is at the Promoter’s sole discretion.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.
- As a condition of accepting the National Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.mitre10.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
